Cuyahoga County commercial property tax appeals
Appeals start with the Cuyahoga County Fiscal Officer and go to the Cuyahoga County Board of Revision. Here is how commercial evidence is built, filed and heard in Cuyahoga County.
- Assessor
- Cuyahoga County Fiscal Officer
- First-level board
- Cuyahoga County Board of Revision
- Filing deadline
- Complaint (DTE Form 1) filed with the Board of Revision between January 1 and March 31 of the year after the tax year, or by the close of first-half collection for the tax year if that is later (R.C. 5715.19(A)(1))
- Commercial assessment level
- 35% of true value (Ohio Adm.Code 5703-25-05(B)) for all classes of real property
- Value standard
- True value in money of the fee simple estate, as if unencumbered (R.C. 5713.01 and 5713.03)
- Valuation date
- January 1 of the tax year (tax lien date)
- Assessment cycle
- Sexennial reappraisal with a triennial update in the third year: reappraisal for tax year 2024 (payable 2025), next triennial update for tax year 2027
- Notices mailed
- Valuation notices are mailed in reappraisal and update years (July in the 2024 reappraisal) with an informal review window through late summer (August 30 in 2024); final values appear on the tax bill mailed in January. No separate annual notice is mailed in other years.
How Cuyahoga County assesses commercial property
Cuyahoga County reappraises every parcel on Ohio's six-year cycle with a statistical update in between. The Fiscal Officer, who holds the county auditor's assessment duties under the county charter, completed the sexennial reappraisal for tax year 2024 (taxes payable 2025), and the next triennial update is due for tax year 2027. Every class of real property is assessed at 35% of true value, so the dispute is always about market value: the assessed figure on the bill follows mechanically.
Ohio has no annual notice-and-protest window. Owners can use the Fiscal Officer's informal review when tentative values are released in a reappraisal or update year, but the formal remedy is a complaint to the Board of Revision on DTE Form 1, filed between January 1 and March 31 of the year after the tax year. Each parcel gets one complaint per triennial period unless a statutory exception applies, which makes the timing decision as important as the evidence.
Hearings are sworn and adversarial. School districts often file counter-complaints to defend or raise a value, the Board wants evidence 7 business days ahead, and an appraisal carries weight only when the appraiser testifies. A consultant preparing a Cuyahoga packet should plan for a market-based income approach on the fee simple estate, a sales grid tied to January 1, and a witness who can stand behind every number. If the Board does not deliver, the next step is the Ohio Board of Tax Appeals or the Court of Common Pleas within 30 days.

Hearings and evidence
Each complaint is set for a sworn evidentiary hearing before a hearing panel acting for the Board of Revision, held in person or by video. The complainant presents first, any counter-complainant (often the school district) follows, and the Fiscal Officer's appraisal staff may respond. Hearings are short and evidence-driven: the panel questions witnesses directly and can ask for additional evidence after the hearing but before it decides.
- 01All evidence is requested 7 business days before the hearing and must relate to the January 1 lien date of the tax year at issue.
- 02The Board may refuse evidence that was not timely submitted, or that is not authenticated or cannot be cross-examined because its author is absent.
- 03A witness with personal knowledge (the owner, property manager, appraiser or other expert) must appear to support the business records, operations or condition of the property.
- 04Income-producing property: submit lease agreements and rent rolls with certified income and expense statements or the relevant schedules of the owner's federal return.
- 05An appraisal must be authenticated by the appraiser at the hearing; a report submitted without the appraiser present is given little or no weight.
Income evidence
Ohio values the fee simple estate as if unencumbered, so the income approach must be built on market rent, market vacancy and market expenses rather than the in-place lease structure. Contract rent from a below-market or above-market lease is evidence, not the answer. A recent arm's-length sale of the subject is treated as strong evidence of value, so when the subject sold within roughly a year of the lien date the case usually turns on whether that price reflects the fee simple interest. For office buildings that lost occupancy after 2020, the Board looks for a normalized operating history, a market vacancy and credit loss figure, and a cap rate supported by current transactions, presented through a testifying appraiser.
Practitioner notes
- Only one complaint per parcel is allowed in each triennial period unless a listed exception applies (an arm's-length sale, a casualty, a substantial improvement, or an occupancy change of at least 15% with a substantial economic impact), so file in the year that matters most, usually the first year of a reappraisal or update.
- Ohio restricts who may file for an owner: the owner, an attorney, or a professional listed in R.C. 5715.19 (such as a licensed real estate broker, a CPA with an Ohio permit, a certified appraiser, or a holder of an IPT designation). A complaint filed by anyone else does not invoke the Board's jurisdiction.
- Since House Bill 126 (tax year 2022 forward), school districts and other subdivisions may file original complaints only after an arm's-length sale at least 10% and an inflation-adjusted $500,000 above the auditor's value, must adopt a resolution first, and cannot appeal a Board of Revision decision to the BTA. They can still counter-complain against an owner's filing.
- A reduction won in the reappraisal year generally carries forward through the next triennial update, so the 2024 values set the base an owner lives with through tax year 2026.
Cuyahoga County appeal questions
Last verified October 2026 against the assessor, board and statute.
When can I file a Board of Revision complaint in Cuyahoga County?
Between January 1 and March 31 of the year after the tax year (or by the close of first-half collection if that is later). A complaint on tax year 2026 values is due by March 31, 2027.
Can I appeal every year?
Generally once per triennial period. A second complaint in the same period is allowed only for a listed change after the prior lien date: an arm's-length sale, a casualty, a substantial improvement, or an occupancy change of at least 15% with a substantial economic impact.
Can the school district raise my value?
It can counter-complain against an owner's complaint and argue for a higher value at the hearing. Since House Bill 126, an original complaint by a school district requires a qualifying sale and a board resolution, and the district cannot appeal the Board of Revision's decision to the BTA.
Does my appraiser need to attend?
Yes. The Board expects appraisals to be authenticated by the appraiser at the hearing, and evidence whose author is absent for cross-examination may be disregarded.
