1.What the service is, and what it is not
ATALI ELECTRIC is a real estate financial technology and tax analytics platform. It ingests assessment notices, benchmarks assessments, normalizes income, builds sales and uniformity comparables, prepares county petition forms and evidence binders, and tracks statutory deadlines.
ATALI ELECTRIC INDIA PRIVATE LIMITED is not a law firm. It does not practice law, does not provide legal advice, and does not represent anyone before an assessor, appeal board, tribunal or court. It does not issue USPAP appraisal reports signed by a licensed appraiser. You, or the consultant, attorney or appraiser you engage, file and present the evidence, and you should verify every packet before filing. Where a board or court requires a signed appraisal or an attorney, you are responsible for obtaining one.
2.Deadlines and jurisdiction rules
Filing windows, forms and evidence rules are set by statute and by each county, and they change. The Deadline Tracker and our jurisdiction pages are aids built from public sources and the dates you enter, and we review them each cycle. You remain responsible for confirming each deadline with the assessor or board and for filing on time.
3.Accounts and security
You must give accurate registration details, keep credentials confidential and require multi-factor authentication for users with access to client data. You are responsible for activity under your accounts and must tell us promptly at security@atalielectric.com if you suspect unauthorized use.
4.Plans, fees and billing
Consultant Pro is $499 per month billed annually ($5,988 a year, up to 30 appeals a year), or $199 per single appeal packet on demand. Firm Scale is $1,499 per month billed annually ($17,988 a year, up to 150 appeals a year). Enterprise Platform is priced by order form. A 14-day free production trial is available to new accounts.
Annual plans renew for successive 12-month terms unless either party gives notice of non-renewal at least 30 days before the renewal date. Fees are due in advance, exclude sales and use taxes, and are non-refundable except where these terms or the law provide otherwise. Unpaid invoices may lead to suspension after 15 days' written notice.
5.Contingency engagements
The Contingency Success Hybrid program carries no upfront fee and a fee of 20% to 25% of first-year realized savings. The appeals themselves are handled by independent partner firms under their own engagement letter with the owner. ATALI ELECTRIC INDIA PRIVATE LIMITED supplies the software and the savings and invoice records, and is not a party to the representation.
6.Customer data
You own the property records, financial statements and other content you upload ("Customer Data"), and the evidence packets generated from it. You grant us a limited license to host and process Customer Data solely to provide, secure and support the service for you. We do not use Customer Data to train or fine-tune AI or machine learning models. Our Data Processing Addendum applies when we process personal data for you.
You confirm you have the right to upload Customer Data, including tenant and owner information, and to authorize our processing of it.
7.Acceptable use
You may not:
- use the service unlawfully or to file knowingly false or misleading evidence;
- reverse engineer, scrape or copy the service, or use it to build a competing product;
- resell or sublicense the service except under a white-label agreement;
- upload malware or probe or test the security of the service without our written permission; or
- share credentials or use one seat for several people.
8.Third-party data and integrations
Integrations with products such as CoStar, ATTOM, Yardi Voyager, MRI, RealPage, AppFolio, Entrata, ARGUS Enterprise, Microsoft Excel, DocuSign, SharePoint and Okta work only with your own licensed accounts and are subject to those providers' terms. We do not warrant the accuracy of third-party data or county records, and market data is used only within the license terms you hold with its provider.
9.Intellectual property
We own the service, its software, models and documentation. We grant you a limited, non-exclusive, non-transferable right to use it during your term. If you give us feedback, we may use it without obligation to you.
10.Warranties and outcomes
We provide the service with reasonable skill and care. Except as stated here, the service is provided "as is," and we disclaim implied warranties of merchantability, fitness for a purpose and non-infringement. Assessment outcomes are decided by assessors, boards and courts. We do not guarantee any reduction, win rate or savings, and published customer results reflect individual customers' experience.
11.Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, and each party's total liability under these terms is limited to the fees you paid in the 12 months before the claim arose. These limits do not apply to your payment obligations, your misuse of the service, either party's indemnity obligations, or liability that cannot be limited by law.
12.Indemnification
You will defend and indemnify us against third-party claims arising from Customer Data you had no right to upload or from your breach of the acceptable use terms. We will defend and indemnify you against third-party claims that the service, as we provide it, infringes a US patent, copyright or trademark.
13.Term, suspension and termination
Either party may terminate for the other's uncured material breach on 30 days' written notice. We may suspend access immediately to stop a security threat or unlawful use. After termination you may export Customer Data for 30 days, after which we delete it as described in our Privacy Policy.
14.Governing law and disputes
These terms are governed by the laws of India, without regard to conflict of laws rules. The courts at Faridabad, Haryana, have exclusive jurisdiction over any dispute, and each party consents to that venue.
15.General
We may update these terms by posting a new version and emailing account owners at least 30 days before material changes take effect. You may not assign these terms without our consent, except to a successor of your business. These terms, any order form and the Data Processing Addendum are the whole agreement. Send legal notices to legal@atalielectric.com or to our registered office in Faridabad.
