- Orange County Assessment Appeals Board
- Filing deadline
- Regular assessments: July 2 to November 30 at 5:00 p.m. (Rev. & Tax. Code §1603; a weekend deadline moves to the next business day). Supplemental, roll change and escape assessments: within 60 days of the notice. Calamity reassessments: within 6 months of the notice

- 100% of taxable value: the lesser of the Prop 13 factored base year value (inflation factor capped at 2% a year) or current market value
- Value standard
- Full cash value or fair market value (Rev. & Tax. Code §110); taxable value under Rev. & Tax. Code §51

- January 1 lien date (Rev. & Tax. Code §2192); base year value set at the date of change in ownership or completion of new construction
- Assessment cycle
- Annual roll as of the January 1 lien date; Prop 13 reassessment only on change in ownership or completion of new construction, plus Prop 8 decline-in-value reviews
- Notices mailed
- Valuation notices are mailed each July for the regular roll; the Clerk certified a November 30 close for 2026 because notices are not mailed to all secured-roll owners by August 1. Supplemental, roll change and escape notices are mailed as events occur
How Orange County assesses commercial property
Orange County follows the California Prop 13 framework: property is enrolled at its base year value from the last change in ownership or new construction, trended by no more than 2% a year, unless January 1 market value is lower under Prop 8. For commercial owners that makes decline-in-value the main appeal, especially for suburban office in Irvine, Newport Beach and Costa Mesa acquired near the top of the cycle. The Assessor Department values property as of the January 1 lien date and mails valuation notices each July.
There are two tracks. The Assessor's informal review runs January 1 to April 30, with separate forms for commercial and industrial property and for hotels, and its results show up on the July notice. The formal track is an Application for Changed Assessment filed with the Clerk of the Assessment Appeals Board between July 2 and November 30, a window the Clerk certified for 2026 because the Assessor does not mail notices to every secured-roll owner by August 1. The County charges no filing fee, but the application must carry an original signature, even when it is prepared in the online system.
Commercial cases are heard by a three-member board, typically 12 to 18 months after filing, and the board must decide within two years under §1604. Exchange of information under §1606 and the Assessor's §441(d) data requests shape what can be used at the hearing, so the income evidence should be assembled early.

Hearings and evidence
Commercial appeals go to a three-member Assessment Appeals Board appointed by the Board of Supervisors from appraisers, brokers, CPAs and attorneys; hearing officers are used for residential cases. Hearings are formal, recorded, and taken under oath, with an Assessor appraiser presenting the county's value. Applications are scheduled first come, first served, with board hearings typically 12 to 18 months after filing, and notice is sent about 60 days ahead. Bring six copies of the evidence. Failure to appear results in denial.
- 01Rev. & Tax. Code §1606: where the roll value exceeds $100,000, either side may start an exchange of information at least 30 days before the hearing, stating the basis of its opinion of value; the response is due at least 15 days before the hearing.
- 02Sales used as comparables may include sales up to 90 days after the January 1 lien date (Rev. & Tax. Code §402.5); sales closer to the lien date carry more weight.
- 03Rev. & Tax. Code §441(d) lets the Assessor require rental income, construction cost and acquisition data; information withheld and then introduced at hearing earns the Assessor a continuance.
- 04For commercial property the applicant carries the burden of proof; the presumption in favor of the taxpayer under §167 is limited to owner-occupied single-family dwellings and certain escape assessments.
- 05Taxes must be paid on time while the appeal is pending; a late payment draws a non-refundable 10% penalty even if the value is later reduced, and refunds include interest.
Income evidence
As elsewhere in California, Orange County income evidence matters most in Prop 8 decline-in-value cases, where the owner must show that January 1 market value has dropped below the factored base year value. Suburban office in the Irvine Business Complex, Irvine Spectrum and South Coast Metro, where many buildings were bought or built at higher values, is the typical candidate. The Assessor's informal review (January 1 to April 30) is the cheaper first step: file the Commercial/Industrial form with the rent roll and operating statement, and if the July notice does not reflect the decline, file the formal application before November 30. At the board, a recent purchase price is rebuttably presumed to be full cash value (§110(b)), and hotels must strip going concern and other intangible value from the income stream (§110(d)).
Practitioner notes
- File early in the July window. Applications are scheduled first come, first served, so an early filing generally gets an earlier hearing date within the two-year limit of §1604.
- Run the informal review and the formal appeal in parallel. An April informal request can produce a corrected July notice, but it does not extend the November 30 deadline.
- Designate the application as a claim for refund under §5097 so a Superior Court action remains available if the board denies relief.
- Supplemental and escape assessments carry 60-day windows from the notice date, which are easy to miss on newly acquired or newly built property.
